Terms and Conditions

Champion Exteriors LLC acts as a general contractor with licensed sub-contractors. Champion Exteriors LLC serves the right to collect any moneys used for purchases during installation. Champion Exteriors, LLC Shall present and submit proof of purchase and any supporting evidence, not limited to media such as video/camera pictures to support additional materials list on Supplement Report that shall be submitted by Champion Exteriors, LLC once installation is complete. Due to unforeseen circumstances, additional materials include but not limited to plywood, ice water barrier, underlayment, seam tape, flashing, asphalt shingles, on-site project manager, etc. shall be procured, and supplied by Champion Exteriors LLC to support a complete, and compliant roof installation that meets all manufacturer's warranty, the State of Connecticut Building Codes and all respective permitted town/city building inspections. It is Champion Exteriors, LLC responsibility to pursue insurer/homeowner for payment.

Exclusive Brand Usage & Lifetime Warranty Coverage Agreement

1. Exclusive Brand Commitment The customer agrees to exclusively use Owens Corningproducts for all applicable purposes under this agreement. Nosubstitutions or alternative brands shall be permitted unless explicitly authorized in writing by customer*.

2. Manufacturer Lifetime Warranty Coverage All Owens Corning products provided under this agreement are covered by the manufacturer’s lifetime warranty. The customer guarantees to honor and extend this warranty by providing additional coverage under the terms of this agreement.

3. Guaranteed Warranty by Seller In addition to the manufacturer’s warranty, Champion Exteriors LLC guarantees full warranty coverage for the lifetime of the product. This includes repair, replacement, or refund for any defects in materials or workmanship, provided the product has been used under normal conditions and in accordance with manufacturer guidelines.

4. *Brand Restriction and Warranty Disclaimer the Contractor exclusively utilizes Owens Corning products for all work performed. If the Customer elects to use a brand not honored by the Contractor, any warranties, guarantees, or claims related to the project shall not be the responsibility of the Contractor. The Contractor assumes no liability for defects, performance issues, or failures arising from the use of unauthorized brands

Business License and Registration

Contractor shall comply with all state and local licensing and registration requirements for the type of Services to be rendered under this Agreement. If applicable, the Contractor’s license and/or registration number is listed in the header of this Agreement. 

Confidentiality Under this Agreement, Customer may provide certain confidential Information or Non-Public Personal

Information (“Confidential Information”) to the Contractor. Contractor will not disclose any Confidential Information to any third party except to those employees or agents of Contractor who are required to have such information for purposes under this Agreement. Contractor shall take reasonable measures to protect the secrecy of and avoid disclosure and unauthorized use of the Confidential Information. Without limiting the

foregoing, Contractor shall take at least those measures that it employs to protect its own confidential information of a similar nature and shall ensure that its employees and/or agents who have access to Confidential Information employ reasonable measures to protect the secrecy and avoid disclosure and any unauthorized use.

Miscellaneous

Authority. Each party represents and warrants that, as of the Effective Date, it has all rights, power, and authority to enter into this Agreement and to perform its obligations.

Assignment. Neither party may, by operation of law or otherwise, directly or indirectly assign this Agreement without the prior express written consent of the other party.

Notices. If either party want to provide notices pursuant to this Agreement, the notices will be provided in writing and sent via email to the email addresses listed in the header of this Agreement.

Counterparts. This Agreement may be executed in counterparts, each of which will constitute an original, and all of which will constitute one agreement. The parties agree that they will sign this Agreement electronically.

Attachments. Any photos or images referenced in this Agreement are attached to the Agreement under “Attachments”. By signing below “customer” agrees to all terms and conditions listed above. Non-payment upon completion will result in “owner” having to pay a penalty of 12% annual interest (1.0% per month) on remaining balances beginning 30 days from the date of completion.

“Customer” is responsible for company’s reasonable attorney’s fees and costs of collection in the event of customer’s failure to pay in accordance with the terms of this agreement. Any changes or unforeseen circumstances that result in any type of alteration to the work above must be expressly written and agreed upon via a signed change order by both parties before additional work begins. “customer” has the right to cancel this agreement until midnight of the third business day after the date on which “owner” signs this agreement within which to cancel this agreement. (Notice of right to cancel below.) “customer” acknowledges receipt of two copies.
